Richard J. Weiss

Richard J. Weiss. Mr. Weiss is Chair of the Firm's corporate department. Mr. Weiss attended Cornell University and earned a B.S. in Operations Research/Industrial Engineering in 1974.  He also attended Adelphi University where he earned an M.B.A. in Finance in 1978. Mr. Weiss graduated from St. John's University School of Law (J.D.) in 1982. For more than twenty years, Mr. Weiss has represented physicians and other healthcare providers in matters concerning their business relationships, including issues related to their practices and hospital affiliations. Mr. Weiss is actively involved with fraud and abuse and anti-referral legislation as it impacts partnership and shareholder agreements, equipment contracts, and real estate transactions. He is also involved with regulatory compliance, practice mergers and acquisitions, business structuring and tax matters.

David A. Zarett

David A. Zarett. Mr. Zarett heads up the Firm's litigation department. Upon graduating cum laude from the University of Rochester in 1982, Mr. Zarett attended the Cardozo School of Law where he was a Notes Editor for the Cardozo Law Review, and received the Jacob Burns Medal after graduating first in his class. For over 20 years, Mr. Zarett has focused his practice on the representation of healthcare providers in state and federal courts, arbitration proceedings, and before numerous administrative bodies. He handles all phases of state disciplinary (OPMC and OPD) investigations and proceedings, medical staff privileging matters, practice dissolutions, restrictive covenant matters, employment and partner buy-out disputes, insurance plan terminations and managed care company audits. Mr. Zarett has represented physicians in a number of matters against academic and teaching hospitals and medical centers, and has handled several cases involving federal antitrust law issues surrounding healthcare business arrangements.

Michael D. Brofman

Michael D. Brofman. Mr. Brofman leads the firm's creditor rights and workout practice. He is a graduate of SUNY at Binghamton (B.A. 1973) and a graduate of Fordham Law School (J.D. 1978). Mr. Brofman possesses over 30 years of experience, including the representation of physicians and other healthcare professionals as litigants in bankruptcy and commercial cases, as well as in debt restructuring and workout matters. Mr. Brofman has a broad business law background that is invaluable to clients in assessing their business prospects and in making informed strategic decisions. He has been involved in numerous bankruptcy cases throughout the United States, primarily representing the interests of creditors. Since 1998, he has represented physicians in most of the hospital Chapter 11 cases filed in the New York metropolitan area.  Mr. Brofman is a frequent lecturer in the areas of bankruptcy, workouts and secured and unsecured creditor rights and Article 9 of the Uniform Commercial Code.

Alan H. Sonnenklar

Alan H. Sonnenklar. Mr. Sonnenklar is a partner in the Firm's corporate department. Mr. Sonnenklar graduated from the University of Pennsylvania (B.A.) in 1990 and Boston University School of Law (J.D.) in 1993, where he earned recognition as a Paul J. Liacos Scholar. He possesses more than fifteen years of transactional, corporate and regulatory experience representing healthcare organizations, physicians and other professionals, group practices, hospitals and other healthcare facilities, management service providers, and other commercial and not-for-profit organizations rendering healthcare and health-related services. Mr. Sonnenklar assists clients with respect to a broad range of business matters and federal and state regulatory issues including corporate formation and organization, physician practice transactions, the development and structuring of joint ventures and other business relationships, contract development and negotiation, HIPAA compliance, certificate of need requirements, and compliance with Stark, anti-kickback, fraud and abuse and fee-splitting prohibitions.

Craig D. Bloom

Craig D. Bloom. Mr. Bloom graduated from SUNY-Buffalo (B.S.) in 1999, Hofstra University School of Law (J.D.) in 2002, and Hofstra University, Frank G. Zarb School of Business (M.B.A.) in 2004. Prior to completing his M.B.A., Mr. Bloom was an analyst at Goldin Associates, L.L.C., where he supported the work of Harrison J. Goldin as court-appointed Examiner in the Enron bankruptcy.  Mr. Bloom primarily represents physicians and other healthcare providers in matters involving employment agreements, restrictive covenants, group practice break-ups, hospital medical staff privileges, investigations by licensing authorities, and disputes with insurance companies.  He is also experienced in representing healthcare providers in managed care and government payor billing audits and appeals, as well as clients involved in general commercial litigation and business related transactions.

Joshua A. Boxer

Joshua A Boxer. Mr. Boxer graduated from the University of Rochester (B.A.) in 1999, the University of Miami School of Law (J.D.) cum laude in 2003, and Boston University School of Public Health (M.P.H.) in 2001. Prior to joining Weiss & Zarett, P.C., he was an associate attorney at Wilson, Elser, Moskowitz, Edelman and Dicker, L.L.P. in the medical malpractice defense group that represented a major New York teaching hospital and its affiliated physicians. Mr. Boxer previously was a judicial staff attorney at the 17th Judicial Circuit Court in Broward County Florida. Mr. Boxer represents healthcare providers in state and federal court litigation, arbitrations and administrative proceedings involving hospitals, insurance companies and other healthcare providers. In addition, Mr. Boxer represents healthcare providers in OPMC and OPD professional misconduct investigations, National Practitioners Data Bank and New York State Physician Profile disputes and administrative appeals, as well as engaging in general commercial litigation. Mr. Boxer also represents healthcare providers in regards to the drafting and/or negotiation of employment contracts, shareholder agreements and related business matters.

Russell I. Sass

Russell I. Sass. Mr. Sass is a graduate of Hofstra University (B.B.A. 2003), and Hofstra University School of Law (J.D. 2007). While in law school, Mr. Sass interned for the Honorable Leonard B. Austin, New York State Supreme Court, Nassau County, Commercial Division. Mr. Sass represents healthcare providers in state and federal court litigation, arbitrations and administrative proceedings involving hospitals, insurance companies and other healthcare providers. Mr. Sass also represents clients in general commercial litigation, as well as creditors and Chapter 7 Trustees in bankruptcy cases.

Harvey Z. Werblowsky

Harvey Werblowsky Esq., recently joined the Firm as “Of Counsel,” and brings to us decades of hands-on experience in a wide array of healthcare and business-related matters acquired over the years as the head of the New York office of a National law firm’s healthcare practice, and before that as a government prosecutor in the healthcare field.  Mr. Werblowsky has represented public and private healthcare companies, hospitals, and physician groups in various corporate, litigation and regulatory matters.  Besides practicing Of Counsel to the Firm, Mr. Werblowsky will continue to serve as a legal consultant and director for several healthcare and business firms.  Mr. Werblowsky received a B.A. from Yeshiva University in 1968 and a J.D. degree from New York University School of Law in 1971.  Before entering private practice, Mr. Werblowsky served as senior counsel to the Office of the Inspector General at the Department of Health and Human Services in Washington, D.C.; held the Office of Deputy Attorney General for the State of New Jersey and the Office of Deputy Attorney General for the State of New York.
